TERMS OF SERVICE

1. Who we are

www.pouchland.shop ("the store") is run by Pouchland, a trading name of VHS Express AB, a company registered in Sweden (organisation number 559494-8050, VAT number SE559494805001), Smidesgatan 7, 417 07 Göteborg, Sweden. "We", "us" and "our" mean VHS Express AB. "You" means anyone who visits the store or buys from it.

These terms apply whenever you use the store or place an order. Our Shipping Policy, Refund Policy and Privacy Policy are part of these terms:

If you don't agree with these terms, please don't use the store.

2. You must be 21 or older

Everything we sell contains nicotine and is for adults only. You must be at least 21 years old to buy from pouchland.shop, in the United States and in Canada, and at least the legal age where you live if that is higher.

By placing an order you confirm that you are 21 or older and that you are buying for yourself, not for anyone under 21. We may ask you to verify your age at any time. If you can't, or if we have reason to think the buyer or the person receiving the order is under 21, we will cancel the order and refund it.

3. Where we ship, and your local rules

pouchland.shop ships to the United States and Canada only.

You are responsible for making sure you can legally buy, own and import nicotine pouches where you live, including any state, provincial or local rules. We may refuse or cancel orders to any destination where we believe the sale is not allowed.

4. Orders

When you place an order you make an offer to buy. We accept it when we ship it. Until then we may refuse or cancel any order, for example if:
- a product is out of stock, or a price or description on the store is wrong;
- we can't verify your age, your payment or your address;
- the order looks fraudulent, uses a discount code it isn't entitled to, or exploits a technical error;
- the order looks intended for resale;
- you have previously broken these terms or filed a chargeback without contacting us first.

If we cancel an order you have paid for, we refund you in full to your original payment method.

We may limit how much one person, household, address, card or account can buy.

5. Prices and payment

Prices are shown at checkout in the currency you see there, and can change at any time before you order. The price you pay is the one shown when you complete your order.

Shipping is calculated at checkout. Customs duties and import taxes are your responsibility, as set out in our Shipping Policy.

Payment is taken when you place your order, or through the payment link we email you. We ship once the payment has come through. Card details are handled by our payment providers; we don't store them.

6. Shipping and delivery

How and when we ship, delivery times, tracking, customs, and what happens if a parcel is lost, seized or delayed are covered in our Shipping Policy. Delivery times are estimates, not guarantees.

Please check your shipping address before you order. If a parcel comes back because the address was wrong or incomplete, we may charge you to send it again.

7. Returns and refunds

Returns and refunds follow our Refund Policy. In short: unopened products can be returned within 14 days of delivery after you contact us at support@pouchland.com, and we can't refund parcels that are lost, seized or delayed for reasons outside our control.

Nothing in these terms takes away any rights you have under consumer protection laws that cannot be waived or limited by contract.

8. About our products

Nicotine pouches contain nicotine, which is addictive. They are not a smoking cessation product and are not sold for any medical or therapeutic use. Keep them out of reach of children and pets.

We show the nicotine strength, pouch count and ingredients that the manufacturer gives us. Brands sometimes change a product without telling us, so always read the can. Pictures are for illustration; the can you get may look slightly different.

We don't give medical advice. If you have questions about nicotine and your health, ask a doctor.

9. Discount codes, giveaways and promotions

Discount codes, store credit, gifts and giveaways (including the spin wheel) follow the rules shown with them. Unless the rules say otherwise: one per person, not for resale, no cash value, and only for customers aged 21 or older. We may cancel any code, credit or prize that was obtained by breaking these rules or through a technical error.

10. Your account

If you create an account, keep your login details safe and tell us if you think someone else has used them. You are responsible for what happens under your account. We may close accounts that break these terms.

11. Using the store

You agree not to:
- use the store for anything illegal, or to buy for someone under 21;
- give false information, including false age or identity details;
- try to break, overload, scrape or get around the security of the store;
- upload viruses or harmful code;
- copy or resell our content, photos or product information without our written permission.

12. Reviews and messages you send us

If you post a review or send us ideas, comments or photos, you let us use, edit and publish them (for example on the store or in our marketing), without payment. Don't post anything that is untrue, unlawful, offensive, or that infringes someone else's rights. We may remove content at our discretion.

13. Other websites and tools

The store may link to other websites or use tools run by other companies (for example payment providers, delivery tracking or review apps). We don't control them and aren't responsible for their content or how they work. Their own terms apply.

14. Our content

The store's design, text, photos and logos belong to us or to the brands we sell, and are protected by law. Brand names belong to their owners.

15. Limits on our liability

We work hard to keep the store accurate and running, but we can't promise it will always be available, error-free or up to date.

To the fullest extent permitted by applicable law:
- the store and our products are provided "as is";
- we are not liable for indirect or consequential losses, such as lost profits or lost data;
- our total liability for any claim connected to an order is limited to the amount you paid for that order.

Nothing in these terms excludes or limits any liability that cannot be excluded or limited under applicable law, including your rights as a consumer.

16. Indemnity

To the extent permitted by applicable law, if you break these terms or the law when using the store and that leads to a claim against us, you agree to cover our reasonable costs, including legal fees.

17. Governing law and disputes

These terms are governed by the laws of Sweden. This does not take away the protection of any mandatory consumer laws of the place where you live, and you may bring a claim in the courts where you live if the law gives you that right.

If something goes wrong, please contact us first at support@pouchland.com. Most problems are solved quickly that way.

18. Changes to these terms

We may update these terms. The version that applies to your order is the one published when you placed it. The date at the top shows when they last changed.

19. Other things

If any part of these terms can't be enforced, the rest still applies. If we don't enforce a right straight away, we haven't given it up. These terms, together with the policies listed in section 1, are the whole agreement between you and us about using the store.
